Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PixQ mobile application, website, and related services (collectively, the "Service") provided by PixQ Labs ("PixQ," "we," "us," or "our").

Please read these Terms carefully. By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

To use the Service, you must:

• Be at least 13 years old (or 16 in the European Economic Area, the United Kingdom, and Switzerland, or the minimum age for data-processing consent in your country if higher)
• Be legally capable of entering into a binding contract under the laws of your country
• Not be barred from using the Service under any applicable laws
• Not have been previously suspended or removed from the Service

If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Your Account

Creating an Account

You can browse a limited portion of the Service without an account. To access features such as favorites, downloads, credits, and subscriptions, you must create an account by providing a valid email address, a password, and a username.

You agree to provide accurate and current information, keep your password secure and confidential, not share your account with anyone, and notify us promptly of any unauthorized use of your account at supportpixq@gmail.com. You are responsible for all activity that occurs under your account.

One Account Per Person

Each user may maintain only one active account. Creating multiple accounts to abuse credits, free trials, or promotional offers is prohibited and may result in suspension of all related accounts.

Account Security

We use industry-standard security practices to protect your account, but we cannot guarantee absolute security. You agree to use a strong, unique password and to enable any additional security features we offer.

License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service on devices you own or control, for your personal, non-commercial use only.

This license does not give you any rights in the Service other than the right to use it as described in these Terms.

Wallpapers and Content License

Our Content

PixQ provides access to a curated library of wallpapers (still images and video wallpapers) and related content ("Content"). All Content is owned by us or licensed to us by its rights holders. Content is protected by copyright and other intellectual property laws.

What You May Do With the Content

• Download Content to devices you own or control
• Set Content as the wallpaper, lock screen, or live wallpaper on your devices
• Keep downloaded Content on your devices while your account remains in good standing

What You May Not Do With the Content

• Resell, sublicense, rent, lease, or redistribute Content
• Use Content in any commercial product, service, or marketing
• Print, reproduce, or distribute Content on physical merchandise
• Use Content to train machine-learning or AI models
• Mint, tokenize, or otherwise create NFTs or blockchain assets from Content
• Post Content to other wallpaper apps, websites, or social platforms as if it were your own
• Remove or alter any watermarks, credits, or attribution
• Decompile, scrape, or bulk-download the library

User Content

If you submit any content to the Service (for example, feedback or support messages) ("User Content"), you keep ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process your User Content for the sole purpose of operating and providing the Service. You represent and warrant that you own or have the rights to your User Content and that it does not violate anyone else's rights or any law. We may remove User Content that violates these Terms or that we believe is harmful, abusive, or infringing.

Subscriptions

Subscription Plans

PixQ offers one or more paid subscription plans that unlock premium features, including unlimited downloads, ad-free browsing, and access to premium Content. Current plans, pricing, and features are shown on the in-app subscription screen.

Billing

All Subscriptions are billed through Google Play Billing. By purchasing a Subscription, you authorize Google Play to charge your selected payment method for the subscription fee in the currency displayed at the time of purchase.

Auto-Renewal

Your Subscription automatically renews at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. Renewal will be charged to your Google Play account at the then-current price. Prices may change with at least 30 days' notice, and you will be asked to accept any price increase before it takes effect.

Free Trials

We may offer free trial periods for new Subscribers. Unless you cancel before the trial ends, you will be charged for the full Subscription at the end of the trial. Only one free trial per user is permitted.

Cancellation

You can cancel your Subscription at any time through your Google Play account settings:

Google Play Store > Menu > Subscriptions > PixQ > Cancel subscription

Cancellation takes effect at the end of the current billing period. You will continue to have access to paid features until that date. We do not offer pro-rated refunds for the unused portion of a billing period. We also provide a direct "Manage Subscription" link inside the app.

Refunds

Purchases through Google Play are subject to Google's refund policy. For refund requests, contact Google Play support first. Users in certain jurisdictions (for example, the EU under the Consumer Rights Directive) may have additional statutory rights.

Changes to Subscriptions

We may change the features, price, or availability of Subscription plans. Material changes will be notified to existing Subscribers at least 30 days in advance.

Credits and In-App Purchases

PixQ uses a virtual currency called "Credits" that can be used to unlock premium Content or features.

You may obtain Credits by purchasing a Credit pack through Google Play Billing, watching opt-in rewarded advertisements, redeeming promotional offers, or receiving Credits as part of a Subscription plan.

Credit rules:

• Credits have no cash value and cannot be exchanged for real money
• Credits are non-transferable between accounts
• Credits are non-refundable, except where required by applicable law
• Unused Credits may expire if your account is inactive for more than 24 months, after termination of your account, or after the Service is discontinued
• We reserve the right to adjust the cost of unlocks, the rate at which Credits are awarded, and the methods of obtaining Credits
• We may revoke Credits obtained through fraud, abuse, chargebacks, or violation of these Terms

Credits are licensed to you, not sold. You do not own them as property; you have a limited right to use them within the Service under these Terms.

Advertising

The free version of the Service is supported by advertisements:

• Rewarded ads are optional. You can watch a short video ad to earn Credits. Rewarded ads are never forced.
• Interstitial ads may appear occasionally between content.

Paid Subscribers do not see ads.

In the European Economic Area, the United Kingdom, and Switzerland, we ask for your consent before showing personalized ads. You can change your preference at any time in Settings > Data & Privacy > Ad Preferences.

By using the free version, you acknowledge that ads help us fund the Service and that ad content is provided by third parties. We do not endorse advertised products or services.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Infringe anyone else's intellectual property, privacy, or other rights
• Upload or share content that is illegal, defamatory, obscene, hateful, harassing, or otherwise objectionable
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service, except where such activity is permitted by applicable law
• Scrape, crawl, mass-download, cache, or index the Service or its Content by automated means
• Circumvent, disable, or interfere with any security, paywall, credit system, rate limit, or access control
• Use bots, scripts, emulators, or automation to interact with the Service
• Transmit viruses, worms, malware, or any other malicious code
• Interfere with or disrupt the Service, its servers, or its networks
• Collect personal data about other users
• Impersonate any person or entity or misrepresent your affiliation
• Resell, rent, or commercialize the Service or any part of it
• Use the Service to train machine-learning or AI models

Violating any of these rules may result in warnings, feature restrictions, suspension, or permanent termination of your account, and may expose you to legal liability.

Intellectual Property

All rights, title, and interest in and to the Service, including the PixQ name, logo, design, source code, databases, Content library, and underlying technology, are owned by PixQ Labs or our licensors and are protected by copyright, trademark, trade secret, and other laws.

Nothing in these Terms transfers any ownership rights to you. The license in "License to Use the Service" is the only right you receive in the Service.

The "PixQ" name and logo are trademarks of PixQ Labs. You may not use them without our prior written permission.

Copyright Complaints (DMCA)

We respect intellectual property rights and respond to valid takedown notices under the US Digital Millennium Copyright Act (DMCA) and comparable laws worldwide. If you believe that Content on the Service infringes your copyright, email supportpixq@gmail.com with the subject "Copyright notice", identifying the copyrighted work, the allegedly infringing Content, and your contact details.

We terminate the accounts of users who are determined to be repeat infringers.

Third-Party Services

The Service uses third-party services to function, including Google Play Billing and RevenueCat for purchases, Google AdMob for advertisements, Supabase for account and backend services, and Sentry for crash reporting. Your use of these third-party services is subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third parties.

Availability, Changes, and Discontinuation

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, add, remove, or change Content, features, and Subscription plans, and impose reasonable limits on storage, bandwidth, or usage.

If we permanently discontinue the Service, we will give Subscribers reasonable advance notice and a pro-rated refund for unused paid periods where required by law.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will meet your requirements, that the Service will be uninterrupted, timely, secure, or error-free, that any errors will be corrected, or that the Service is free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply only to the extent permitted by law, and you may have additional statutory rights.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIXQ LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS (USD 50).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law, and nothing in these Terms limits liability that cannot be limited under applicable law.

If you are a consumer in the European Economic Area or the United Kingdom, your statutory rights are not affected by this Section.

Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless PixQ Labs and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Service, your violation of any law or the rights of any third party, or your User Content.

Termination

Termination by You

You may stop using the Service and delete your account at any time through Settings > Account > Delete Account in the app, or through our web deletion page at https://pixq.app/delete-account.

Termination by Us

We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, your account is linked to fraud, abuse, or chargebacks, it is required by law, or you have not used the Service for an extended period.

Effect of Termination

Upon termination, your right to use the Service ends immediately. Your account and associated data will be deleted in accordance with our Privacy Policy. Unused Credits are forfeited, except where required by law. Active Subscriptions will continue until the end of the paid period managed by Google Play unless you cancel separately through Google Play. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to them or the Service are governed by the laws of India, without regard to conflict-of-laws principles.

Before filing any formal dispute, you agree to first contact us at supportpixq@gmail.com and attempt to resolve the matter informally.

Any dispute that cannot be resolved informally will be brought exclusively in the competent courts of India, unless mandatory consumer-protection laws in your country require otherwise.

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose laws protect consumers from forum-selection clauses, nothing in this Section limits your right to bring proceedings in the courts of your home country.

Where permitted by law, you agree that any dispute will be resolved only on an individual basis and not as part of any class, consolidated, or representative action.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page, notify you by in-app notice or email at least 14 days before the changes take effect, and ask for your acceptance of material changes where required by law.

Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not agree, you must stop using the Service and may delete your account.

Miscellaneous

• Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
• No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms without our written consent. We may assign these Terms to any affiliate or to a successor in interest.
• Force majeure: We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
• Notices: We may provide notices by in-app message, email, or by posting on the Service.
• Language: These Terms are written in English. Translations are provided for convenience only; the English version controls in case of any conflict.
• Relationship: Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between you and us.
